By accessing and using the PersonAIzer platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PersonAIzer provides a platform for creating, customizing, and deploying interactive 3D AI personas. The Service includes access to AI-powered conversational characters, speech-to-text and text-to-speech capabilities, and related tools and features.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Providing accurate and complete information when creating your account

4. Subscription Plans and Billing

Our Service offers various subscription plans with different features and usage limits:

  • Free Plan: Limited features and usage as specified on our Pricing page
  • Paid Plans: Monthly or annual subscriptions with specific features and limits
  • Usage Limits: All plans are subject to storage, session time, and concurrent session limits
  • Billing: Paid plans are billed in advance on a monthly or annual basis
  • Cancellation: You may cancel your subscription at any time, with access continuing until the end of the current billing period

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to the Service or related systems

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by PersonAIzer LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create using the Service, including custom personas, models, and configurations. By using the Service, you grant PersonAIzer a license to use, store, and process your content solely for the purpose of providing the Service.

7. User Content

You are solely responsible for all content you create, upload, or transmit through the Service. You represent and warrant that:

  • You have the right to use and share such content
  • Your content does not violate any third-party rights
  • Your content complies with all applicable laws

PersonAIzer reserves the right to remove any content that violates these Terms or is otherwise objectionable.

8. AI-Generated Content

The Service uses artificial intelligence to generate responses and content. You acknowledge that:

  • AI-generated content may not always be accurate or appropriate
  • You are responsible for reviewing and moderating AI-generated content
  • PersonAIzer is not liable for any harm caused by AI-generated content
  • You should not rely solely on AI-generated content for critical decisions

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Maintenance and updates
  • Technical issues or failures
  • Circumstances beyond our reasonable control

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERSONAIZER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless PersonAIzer LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tbilisi, Georgia.
